Referendum

The  Misterton with Walcote Neighbourhood Plan Examiners Report was submitted to Cabinet on 8 March 2021 to consider all the recommended modifications and to consider and approve the date of the referendum.

The Cabinet meeting approved all of the Examiners recommended modifications and set the referendum date as  the 3 June 2021. The Decision Notice was issued on 22 April 2021.

The Misterton with Walcote Neighbourhood Plan Decision statement of the Local Planning Authority’s satisfaction that the referendum version Neighbourhood Plan meets the basic conditions specified by statute and complies with the provision made by or under Section 38A and 38B of the Planning and Compulsory Purchase Act 2004

The referendum held on 3 June 2021 met the requirements of the Localism Act 2011; it was held in the Parish of Misterton with Walcote and posed the question:

'Do you want Harborough District Council to use the Neighbourhood Plan for Misterton with Walcote to help it decide planning applications in the Neighbourhood area?'

The count took place on 3 June 2021 and greater than 50% of those who voted were in favour of the Plan being used to help decide planning applications in the plan area. The results of the referendum were:

Submission of Misterton with Walcote Neighbourhood Plan

Misterton with Walcote Neighbourhood Plan was submitted by Misterton with Walcote Parish Council, as the Qualifying Body, to Harborough District Council for examination on 19 February 2020. A validation check has been completed.

Regulation 16 Consultation

In accordance with the regulations the dates for the Regulation 16 consultation were between 26 August  and 7 October 2020. Representations were sought from stakeholders and other consultees and all representaions have been forwarded to the Independant Examiner.

Appointment of Independent Examiner

Mr Christopher Collison has been appointed by the District Council for the independent examination of the Plan with the agreement of the Qualifying Body.

Examination Report

The final report was received from the Independent Examiner on 25 Jan 2021. The report states that subject to the recommended modifications the Misterton with Walcote Neighbourhood Plan meets the Basic Conditions and should proceed to referendum. On March 8 the District Council Cabinet will consider all of the recommendations and make their decision whether Plan should proceed to referendum.

Strategic Environmental Assessment

Harborough District Council undertook a screening of the draft Misterton with Walcote Neighbourhood Plan in February 2020 for the purposes of Strategic Environmental Assessment (SEA). The statutory consultees were contacted for comment and the determination was issued by the Council in July 2020 that the Plan did not require a full SEA to be undertaken.. Misterton with Walcote Parish Council, as the relevant body, applied for the designation of the Misterton with Walcote Neighbourhood Area on 10 February 2017. The application for the Neighbourhood Area is the entire Parish of Misterton with Walcote.

In accordance with Regulation 5A of the Neighbourhood Planning Regulations the Local Authority must exercise their powers under section 61G of the 1990 Act to designate the specified area as a neighbourhood area.

Harborough District Council confirmed the designation of Misterton with Walcote Neighbourhood Area on 3 April 2017.
