Referendum

At the Execuitve meeting on 13 November 2018, Executive Committee approved all of the Examiners recommended modifications to the South Kilworth Neighbourhood Plan to proceed to referendum on 10 January 2019.

The South Kilworth Neighbourhood Plan Decision statement of the Local Planning Authority’s satisfaction that the referendum version Neighbourhood Plan meets the basic conditions specified by statute and complies with the provision made by or under Section 38A and 38B of the Planning and Compulsory Purchase Act 2004

The Neighbourhood Plan Referendum Information Statement sets out the arrangement for the Referendum including costs and voter numbers

Referendum Result

A referendum was held on 10 January 2019 and a ‘yes’ vote was returned with 140 out of 145 persons that voted, voting ‘to use the Neighbourhood Plan for South Kilworth to help it decide planning applications in the Neighbourhood area.’

Final Decision Statement

Harborough District Council has assessed that the South Kilworth Neighbourhood Plan, including its preparation, does not breach, and would not otherwise be incompatible with, any EU obligation or any Convention rights (within the meaning of the Human Rights Act 1998).

In accordance with the Regulations and the Council's scheme of delegation the South Kilworth Neighbourhood Development Plan is 'made' and planning applications in the Parish must be considered against the South Kilworth Neighbourhood Development Plan, as well as existing planning policy, such as the Harborough District Core Strategy and the National Planning Policy Framework and Guidance

 

Referendum Result

The referendum held on 10th January 2019 met the requirements of the Localism Act 2011; it was held in the Parish of South Kilworth and posed the question:

'Do you want Harborough District Council to use the Neighbourhood Plan for South Kilworth to help it decide planning applications in the Neighbourhood area?'

The count took place on 10th January 2019  and greater than 50% of those who voted were in favour of the Plan being used to help decide planning applications in the plan area. The results of the referendum were:

Submission to Harborough District Council

South Kilworth Parish Council as the Qualifying Body submitted the South Kilworth Neighbourhood Plan on 7 May 2018. The Council has undertaken a validation check and the Plan will now proceed to a 6 week regulation 16 consultation from Wednesday 20 June 2018 ending on 1 August 2018.

Regulation 16 Consultation

In accordance with the regulations the dates for the Regulation 16 consultation were between 20 June to 1 August 2018.

Examination

Harborough District Council, with the agreement of the Qualifying Body, has appointed Mr Nigel McGurk as Independent Examiner for the South Kilworth Neighbourhood Plan. The Examiner has confirmed that a public hearing will not be required.

Examiners Report

The Examiners report into the South Kilworth Neighbourhood Plan was received by the Council on 17 September 2018, and the Examiners recommended modification will be considered by Executive Committee on 13 November 2018.

Subject to Executive Committee approval on 13 November 2018 the South Kilworth Neighbourhood Plan will proceed to Referendum on 10 January 2019.

Strategic Environmental Assessment

South Kilworth Parish Neighbourhood Forum asked the LPA to screen the South Kilworth NDP for requirement for a Strategic Environmental Assessment (SEA). A screening report was provided in May 2018 for the submission version of the Plan. Statutory Consultees (Natural England, Historic England and the Environment Agency) were asked for their comments in May 2018.

Harborough District Council is now able to issue its determination concerning the requirement for an SEA for the South Kilworth Neighbourhood Plan. The Authority has determined that a full SEA is not required because, in the opinion of the Authority, there will not be significant detrimental effects to either the natural or historic environment due to policies in the South Kilworth Plan.

South Kilworth Parish Council, as the relevant body, applied for the designation of the South Kilworth Neighbourhood Area. The application was published for a six week period ending on  18 March 2016 and was approved by the Portfolio Holder for Planning Services on 22 March 2016.
